Every strong community needs a foundation. For us, that foundation will be our Constitution. It should outline who we are, how we govern ourselves, and what values we stand for.

Here are some key areas we might want to cover:

Identity & Principles: What are the core values of the UC?
Government Structure: How should leadership be chosen? Should it be elected, appointed, or rotational?
Membership: What does it mean to be a citizen of the UC? Rights, duties, expectations?
Law & Decision-Making: How do we create, change, or remove rules?
Symbols & Representation: What role do our flag, seal, and other emblems play in uniting us?

This is just a starting point. Nothing is set in stone, the constitution should reflect our collective vision.

So, I’d like to open the floor:

The most foundational aspects have already been decided save for one - the decision-making process. It needs to be smooth and efficient, something of vital importance at such an early stage in the region’s life, wherein largely any citizen of the U.C. can propose legislation and any proposed legislation can be debated, approved, or denied within 48 hours of its initial proposal. Allowing anything to get bogged down by bureaucracy at such a vital point in the region’s life would simply bring a rapid end to that life. That being said, I propose the following:

Until a certain membership threshold is reached, legislation - from concept to adoption - should be handled through one individual, name to be determined but unimportant at this time. This individual is the authority for presenting legislation to the Floor for debate or vote and ensures that legislation meets formatting rules and doesn’t break the legal framework already set out by the Constitutional Concept.

a. This individual should not be the WA Delegate - most often the Delegate is elected not based on skill in writing legislation but on other factors. Not a diss to the Office of the Delegate, but an observation, nonetheless.
Legislation should be passed by a simple majority to be enacted to ensure it is not slowed down by inactive participants. All citizens of the region should be considered voting members at this stage to allow a free flow of ideas and representation.
Following a certain period of time or other tangible threshold, a constitutional convention shall be held to review the legislation passed up to that point and decide what was necessary for growth and can be removed, and what is core to the region as a whole and should stay.
The legislative body of the U.C. should remain unicameral due to the small population of the region. The legislative body should also double as the judicial body at this stage, with judicial proceedings being largely similar to legislative ones, to improve understandability and flow. The legislative body should also be the final say in the legislative process, with no executive authority to overrule or veto passed legislation. With the exception of Thessara, no nation has more say than any other, up to and including those of us who have endorsed others to climb to the WA Delegate position, which has already changed hands twice now.
The Constitution must include protections for the citizens, which appears to be mostly already covered in the framework thus far provided.

This is simply my thoughts on the matter - if anyone has anything they’d like to add or concerns they would have, lets discuss! I’m a firm believer in no idea is a bad idea, especially this early on in the process, so I am not married to anything I’ve written.

Preamble

We, the citizens of the United Commonwealth, establish this Constitution to define our union, uphold our shared values, and guide the governance of our community.

Article I — Identity & Principles

The United Commonwealth (UC) is a voluntary regional community founded on cooperation, representation, and respect.
Sovereignty amongst nations is preserved except where specifically limited by this Constitution.
The UC exists to promote internal stability, represent its citizens externally, and to coordinate regional policy.

Article II — Citizenship and Rights of Citizens

To be considered a citizen, nations must:
1. Reside within the Region of the United Commonwealth, and
2. Have completed a standardized citizenship application process as defined by law.
Citizens retain the rights to:
1. Free and open elections and referenda,
2. Eligibility to run for public office when a vacancy exists,
3. Participate in debate and the legislative process, and
4. Let their voice be heard throughout the Region, so long as it does not violate laws enacted by the Council.
Citizens may not be arbitrarily excluded from participation without due process.
Citizenship may be revoked under conditions defined by law, including violation of regional policy and standards.
Mechanisms for repeal of judicial decisions shall be defined by law.

Article III — Government Structure

Governing authority is vested in the Council of the Commonwealth, “the Council.”
The Council shall consist of representatives chosen by the citizens of the UC under a system of elections defined by law.
Executive authority is exercised collectively by the Council and operationally carried out by designated offices established by law, including but not limited to:
1. World Assembly Delegate, external representative to the World Assembly.
2. Chief Ambassador, representative to other regions of the world and speaker on behalf of the UC.
3. Speaker of the Council, facilitator of the legislative process of the UC and, until such time as defined by law, the Head of State of the UC.
The powers, limits, and selection process for these positions is to be defined by law, but may not contradict this Constitution.

Article IV — Legislative Authority

The Council shall be the Legislative Authority of the UC, and shall propose, debate, and enact legislation governing the UC.
A simple majority shall be sufficient for standard legislation unless otherwise specified.
Quorum requirements shall be defined by law to ensure legitimacy of votes.
1. Until defined by law, any vote with at least three participating citizens shall constitute a quorum.
Emergency powers, if granted, shall be narrowly defined, specific, and subject to review.

Article V — Elections and Terms

Elections for public office shall be conducted at regular intervals determined by law.
All citizens in good standing are eligible to vote in elections and referendums.
Term lengths, re-election limits, and voting systems shall be determined by law.
Election integrity mechanisms must be defined and enforced as defined by law.

Article VI - Amendments

Amendments to this Constitution require:
1. Proposal by a member of the council or a defined percentage of Citizens.
2. A defined period of public debate no less than 24 hours.
3. Approval by a two-thirds majority of the Council or direct citizen vote, as defined by law.
No amendment may remove fundamental citizen’s rights without a direct popular vote.

Article VII - Symbols

The official symbols of the UC, including its flag and seal, represent the unity and shared identity of its citizens.
The design and use of these symbols shall be governed by standards set by the Council in law.

Article VIII - Supremacy and Interpretation

This Constitution is the supreme governing authority of the UC.
Enforcement of this supremacy shall be defined by law as either vested in a regional officer or The Council through a majority vote.
Conflicts between law and Constitution shall be resolved in favor of the Constitution.
A mechanism of judicial review within the legislature shall be established by law to interpret constitutional disputes.

Article IX - Transitional Government

Notwithstanding Article III, until the UC reaches a legally defined threshold of politically active citizens, legislative intake shall be managed by a designated Legislative Officer.
1. The Founder of the UC shall conduct a regional vote within 48 hours of passage of this Constitution to select the Legislative Officer.
2. All citizens may run in this special election.
3. All citizens may vote in this special election, including those running in the election.
4. Upon election, the Legislative Officer shall immediately commence legislative duties, including but not limited to fulfilling the legal requirements set forth in this Constitution and defining the end of the Transitional Government via a popular vote of citizens.
This officer shall:
1. Review proposals for format and constitutional compliance.
2. Advance proposals to debate and vote.
3. Maintain legislative flow within defined time limits.
This position shall not be held concurrently with the World Assembly Delegate.
The Legislative Officer may be removed at any time following majority consent of the citizenry. Decisions of the Legislative Officer may be overridden with a majority vote.
Legislative cycles shall not exceed 48 hours from proposal to vote unless extended by majority consent.
All citizens shall retain voting rights during this period.
Governing authority will not be granted to the Council during this period, but rather to specific Officers as defined by law.
To protect the region during this vulnerable time, all Administrative actions shall be confined to the Regional Founder. The World Assembly Delegate position shall be stripped of all its Regional Powers, save for World Assembly related permissions.
1. The World Assembly Delegate may be granted Regional Powers as defined by law.
The Transitional Government will automatically end and governing authority transition to The Council six months after the passage of this Constitution.
This Constitution requires a two-thirds vote of citizens to go into effect, at which point Article IX is the convening authority for the Transitional Government.

Greica, I’ve spent some time with your draft. It’s a great, professional legal framework and I think that you’ve nailed the ‘safety’ and ‘stability’ side of things. I love these kind of incentives. So thank you for that. 💖

However in the spirit of collaboration, I will bring some of my real life experience into this discussion.

In a new region 48 hours are critical for retention, to avoid that type of stress, I took the necessary time to build upon the vision of a United Commonwealth and change substantially the narrative, therefor, the first few days and rarely weeks - are critical for retention.

When a new member joins and sees a ‘Transitional Government’ that is still ‘figuring out’ its departments, they won’t stay. They stay when they see a Secretary of State position to aim for or a Treasury system they can interact with immediately. I’d like to build on your foundation by adding the ‘Incentive Layer’ I am all about. My worry with a six-month ‘Transitional’ period is that new members might feel there’s nothing to do but wait. To keep the ‘Organizational’ and ‘RP spirit’ alive from Day 1, I’d love to integrate these specific refinements into your Articles:

I’ve drafted some specific language for these articles that blends our two visions. What do you think about adding these ‘functional’ details to your existing structure to give new members more to do?"

The Refined (Collaborative) Article Language:

Article III — The Executive Branch

Section 1: The Presidency. Executive authority is vested in the President, who shall serve as the Head of the Federal Branch and Head of State.
Section 2: The Cabinet. The President may appoint four Secretaries to lead the following Federal Departments:
- Department of State: Manages foreign outreach, recruitment, and embassies.
- Department of Internal Affairs: Oversees regional stability and citizen services.
- Department of Defense: Coordinates regional security and military roleplay.
- Department of Treasury: Tracks the regional economy, trade, and member salaries.
Section 3: The Mayor. There shall be an office of the Mayor, who acts as the Community Manager. The Mayor is responsible for domestic engagement, organizing regional events, and fostering a welcoming environment for new citizens.

Article IV — The Legislative Branch

Section 1: The Hybrid Senate. Legislative power is held by the Senate.
Section 2: Scaling Representation. To drive regional growth, voting seats in the Senate shall be allocated at a 1:4 ratio (one Senator for every four citizens).
Section 3: Consultative Capacity. All citizens may participate in Senate deliberations as non-voting members, ensuring every voice is heard while maintaining a clear leadership ladder.

Article V — The Judicial Branch

Section 1: Judicial Oversight. A Judicial body is hereby established to oversee the implementation of laws and ensure all government actions comply with this Constitution.
Section 2: Dispute Resolution. This body shall serve as the final arbiter for legal disputes between citizens or government branches.

Article IX — Regional Security & The Founders Guardianship

Section 1: The Guardianship Mandate
As the creator and legal sustainer of the region, the Founder (Thessara) serves as the High Guardian of the Commonwealth. This office exists outside the standard political cycle to ensure the region’s long-term survival and adherence to its founding mission.

Section 2: The Security Kill-Switch
The Founder retains the absolute authority to bypass standard judicial or legislative processes to “Eject” or “Ban” any nation, or dissolve any government body, under the following Emergency Triggers:

OOC Misconduct: Any instance of bullying, harassment, or “toxic” behavior that violates Out-Of-Character (OOC) community standards.
Subversion & Coup Prevention: Any coordinated attempt to overthrow the Constitution, seize the Delegacy through illegal means, or “raiding” the region.
Institutional Deadlock: If the Government (President, Senate, or Judiciary) becomes completely inactive or paralyzed, the Founder may reset that branch to restore functionality.

Section 3: Finality of Decision
Actions taken under the Security Kill-Switch are final. While the Founder may seek a “Senate Vote of Opinion” to maintain transparency and collaboration, the ultimate authority to secure the region’s safety rests solely with the Founder.
